President Donald Trump is poised to issue the first veto of his presidency after a dozen defecting Republicans joined Senate Democrats to block the national emergency he'd declared at the border. "Congress has the freedom to pass this resolution and I have the duty to veto it", Trump said from the Oval Office.
The Democratic-controlled House of Representatives had passed the resolution to overturn the emergency last month, and 12 Republicans sided with Democratic Senators to clear the Senate in a 59-41 vote on Thursday afternoon.
While Democrats control the House, they would need a total of 67 votes in the Senate to override Mr Trump's veto.
"It is definitely a national emergency; rarely have we had such a national emergency", he insisted.
"The situation at the border has deteriorated, moreover, because the population of migrants crossing the border has shifted from one that consisted primarily of single adults from Mexico, who often could be promptly repatriated, to one that includes large numbers of families and children from Central American countries - people who cannot now be detained in any significant numbers and who are generally more hard to remove", the letter states.

Trump tweeted about the political advantage he expects those who supported him will receive.
"The fact that this is an emergency is undeniable", Nielsen said.
"We clearly have a [border] crisis and we have to address it", Republican Senator Rob Portman told reporters. So, as a practical matter, the administration can continue to spend billions of dollars more on border barriers than lawmakers authorized, unless and until the courts intervene.
"I think the basic premise of Mike [Lee's] bill is correct", Republican Senator Jerry Moran said Thursday.
The resolution was approved in the aftermath of the killing of US-based Saudi journalist Jamal Khashoggi in the Saudi Consulate in Istanbul on October 2, 2018. Against the advice of GOP leaders, Trump invoked the national emergency declaration last month, allowing him to try to tap about $3.6 billion for the wall by shuffling money from military projects, and that drew outrage from many lawmakers.
Researchers have said that immigrants are less likely to commit crimes, despite Trump repeatedly linking immigration and crime. His signature ended a 35-day partial shutdown of the federal government, which had been triggered by a showdown after Congress refused to appropriate the $5.7bn he requested to start construction at the border.
